INTRODUCTION : There are a number of useful texts which analyze various facets of insurance law from a national perspective. For example, Allan Windt's book Insurance Claims and Disputes (2nd ed. 1988) provides an excellent overview of majority and minority rules applied in insurance coverage litigation. Robert Keeton and Alan Widiss' text Insurance Law (1988) provides a good analysis of the theoretical underpinnings of insurance law. However, these books are of little help to the busy Minnesota lawyer, claimsperson, underwriter, agent or insured who needs a concise overview of Minnesota insurance law. The authors have written this book to help fill that critical gap. Minnesota Insurance Law does not seek to analyze the facts and details of all the state's insurance cases. The result would have been a massive text of little use or interest to anyone. Instead, the authors have chosen cases which contain the clearest statements of Minnesota insurance doctrine and policy. Likewise, the authors have not attempted to provide a catalogue of all the state's insurance laws. Instead, the book analyzes the legal principles which arise in litigation. This focus on actually-litigated es should ensure that the book has a sense of proportion - focusing on the doctrines of most importance to the practitioner and insurance person. When necessary to fill in gaps in Minnesota case law, the authors have cited authorities from other jurisdictions. In particular, this was essential in the chapters on pollution liability, employee benefit plans and reinsurance. On such cutting-edge issues, other jurisdictions are a good predictor of what the Minnesota courts will do.
