When this book was first published in 1993, ADR practice was in its infancy. Nearly a decade later, Alternatives to Litigation, Second Edition, has been revised and expanded to reflect the growing interest—and in some states mandatory use—of alternative dispute resolution. The book explores key concepts and terms, and addresses practical how-to issues that all attorneys need to recognize and master regardless of their field of expertise. The following additions have been made to the second edition: The arbitration chapter includes new case law, and a section on drafting arbitration clauses. The negotiation chapter includes an in-depth section on communication skills. The mediation chapter contains information about various types of ADR. A new chapter has been added on divorce mediation. Appendices include an agreement to mediate, an opening statement checklist, a contract for arbitration, and abbreviated clauses for standard business agreements.
