Appointed justice Supreme Court of the New York, 1885, elected, 1886. Member Court of Appeals, 2d Division, 1889-1892.
Member general term. 1893-1896, of Appellate Division, 1896-1897.
Chief justice of Court of Appeals of New York, January 1, 1898-August 5, 1904. Resigned to accept Democratic nomination for the Presidency made on first ballot, July 9, 1904. Delegate-at-large and New York member platform committee Democratic National Convention, 1908.
Permanent chairman Democratic State Convention, New York, 1908, temporary chairman, 1910, permanent chairman, 1912.
Again practicing law as member Parker, Marshall, Miller and Auchincloss. Was chief counsel for managers impeachment trial of Governor Sulzer, 1913.
Vice-president League to Enforce Peace. President National Civic Federation, since 1919.
