The Sixth Edition updates the treatment of the usual topics and significantly rearranges the structure. A new chapter titled “Loss Allocation” combines previous chapters on general average, marine insurance, and limitation of liability into a single presentation. This new chapter addresses questions such as whether a potential loss can be reallocated in advance; whether to leave the loss where it falls or to make the duty-breacher pay; and whether the loss is limited, shared, or diverted to another party. The editors have sought to keep the Sixth Edition both comfortable for long-time users and accessible to new users.

The editors have sought to keep the Fifth Edition comfortable for long-time users and to make it accessible to new users.

The authors have avoided including medical and legal horror stories; instead, a good many cases illustrate commonplace situations in medical practice that lawyers have to discuss with doctors over and over. The medical practitioner orientation looks at negligence, informed consent, bioethics, and insurance through the eyes of doctors and other health care providers. The authors are not plaintiff-oriented or defendant-oriented; they are trying to show the interplay of lawyers and doctors in many roles.
