Excerpt from Argument of Hon. F. Carroll Brewster in the Case of Swasey Vs. North Carolina R. R. Co. Before Hon. Morrison R. Waite, Chief Justice of Supreme Court of the United States, and Hon. Hugh L. Bond, Circuit Judge, Raleigh, June 8, 1874: And Opinion of the Chief Justice Lastly, to the propositions Of law upon which my motion rests. The' contract we set up may be stated in a few words. We say that in the year 1849 the State of North Carolina created a Railroad corporation - sub scribed to two millions of the stock - invited loans to pay for this stock, and issued to the persons advancing the money, interest bearing bonds, and that the State pledged for the payment of these bonds and their interest, the stock thus purchased and all its dividends. Those bonds, with heavy arrears of unpaid interest, we this day represent at your bar, and we Simply ask that the stock pledged for these payments - the stock bought with our money - our stock - be sold to satisfy our just demand. She who never paid one dollar for a Single share, She who for years received and misappropriated the dividends, still seeks to hold these millions. Excerpt from Gilman, Et Al. Vs. The City of Philadelphia: Argument of F. Carroll Brewster, Esq., City Solicitor, Delivered Before the Supreme Court of the U. S., December 12th, 1865 The river which it is thus proposed to span, is not a stream flowing between two commonwealths, or having its rise in one and its mouth in another State; but every drop of its current, from its source to its junction with the Dela ware, has its flow within the boundaries of Pennsylvania. The bed of the stream is owned by that State, and by it only. The waters of the river wash no shores, but those over which Pennsylvania has exclusive jurisdiction; and this stream is just as much subject to her control as is every other highway within the State. Excerpt from Molière in Outline: Being a Translation of All Important Parts of Molière's Works, With Introductions and Notes, Historical and Critical, Abridged From Van Laun and Others, to Which Are Added the Arguments of the Plays, Etc Such a nersonage - as I read his works - we may discover in Moliere. His plays were addressed to an age and a people who would not have understood his language had it not been sea~ soned with expressions we now condemn. For this reason perhaps he has not been read or studied by those who were not willing to encounter offense. But it has occured to me that if the pure gold could be sifted, and the grains thus secured be offered - ih a shape, no father need hesitate to present to a daughter - the labor might be re-paid by the pleasure secured to a class not hitherto reached. This has been my cardinal object in preparing this work. I have had another purpose in view. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Frederick Carroll Brewster was born on May 15, 1825 in Philadelphia, Pennsylvania and was the son of Francis Enoch and Maria (Hampton) Brewster and the brother of Benjamin Harris Brewster.
Frederick Brewster was educated at the Old Friends Select School, and University of Pennsylvania, graduating from the latter in 1841. He then studied law in his father's office.
After studying law in his father's office, Frederick Brewster was then admitted to the Philadelphia bar in September 1844. Brewster's early prominence was due mainly to his association with three sensational criminal cases, in which he appeared for the defense, obtaining acquittals in each. In Commonwealth vs. Cunningham, very fine legal points were involved. The accused, a policeman, shot a man who was resisting arrest, and it was decided that a well-founded apprehension of bodily harm is sufficient to justify the taking of life.
Commonwealth vs. Lenairs, another murder case with a plea of selfdefense, was distinguished more by the local animosities sought to be imported into the trial than by its legal features, and Brewster's successful defense was at the time considered extremely brilliant.
In the third case, one Kirkpatrick was accused of conspiracy to poison his brother. It excited great interest in society circles, the trial lasted four weeks and Brewster secured an acquittal in the face of strong public opinion and apparently convincing evidence. From that time forward he was recognized as a leader of the bar.
Closely following came the failure of the Bank of Pennsylvania, and the indictment of its president, Thomas Allibone, for conspiracy to defraud the bank of $250, 000. Brewster was retained for the defense and after a trial extending over three weeks obtained a verdict of "not guilty. "
He was counsel in the Schollenberger-Brinton case, which established the constitutionality of the Legal Tender Act of 1862, and the Chestnut Street Bridge case, which established the right of the city to bridge the Schuylkill. On the expiration of his term in 1865 he was reelected, but resigned in October 1866 in order to accept the position of judge of common pleas of the city and county of Philadelphia, which he occupied for three years.
He became attorney-general of the state at the request of Governor Geary, October 23, 1869, and held this office till the latter part of 1872.
On his retirement he resumed active practise in Philadelphia.
His association with one cause celebre occasioned a remarkable tribute. In the Mintzer case he had induced the jury to upset a will under unusual circumstances, and one reason adduced for a reversal on appeal was that so irresistible had been his eloquence that no twelve sane men in the world could have failed to be controlled by it.
In December 1898 he started for Florida in search of health, but died on the train near Salisbury, North Carolina.
Frederick Brewster achieved his greatest forensic triumph in 1856, appearing for W. B. Mann, in the celebrated political contest between the latter and L. Cassidy for the office of district attorney. But his chief achievement was in his appointment as an attorney-general of the Pennsylvania state at the request of Governor Geary on October 23, 1869, and serving in this office till the latter part of 1872. He also wrote a number of works regarding the judicial system of Pennsylvania and was the author of Reports of Equity, Election and Other Important Cases--Principally in the Courts of the County of Philadelphia 1856-73, A Treatise on Practice in the Courts of Pennsylvani, A Treatise on Practice in the Orphans' Court (1894) and A Treatise on Equity Practice in Pennsylvania (1895). He also made contributions to general literature including Disraeli in Outline (1890) and From Independence Hall around the World (1895).
