This book is an attempt to give an account of the law of Husband and Wife with more detail than is possible in a systematic view of the whole law of Scotland, such as Bell s Principles, marvel of condensation though that is, without aiming at the exhaustive treatment of a work like that of Lord Eraser. In England, such monumental works as those by Lord Justice Lindley on Partnership and Company Law; by Addison on Contracts ;T aylor on Evidence ;or Jarman on Wills to give only a few examples have been found not to prevent the usefulness of books on a smaller scale dealing with the same subjects. And in Scotland the success of Professor Kirkpatrick sbook on Evidence, and Mr. Craigie svolumes on Heritable and Moveable Rights, shows that there is a demand for works of a moderate size. I have been further encouraged by the facts that during the seventeen years which have elapsed since the publication of the second edition of Lord Eraser sstandard treatise, the number of cases decided in this branch of the law has been very considerable, and that a profound alteration in the position of a wife with regard to property has been efifected by the Married Women s Property A ct of 1881. The constant references made to Lord Eraser swork sufficiently indicate my great indebtedness to it as a storehouse of the authorities prior to its date. Agriculture Both the Dominion and the Province have power to legis-immigration, late on these subjects, but if any conflict arises a provincial law will receive effect only so far as it is not repugnant to any Act of the Parliament of Canada (s. 95.). 18. General residuary power of Federal Parliament. With regard to the powers of the Federal Parliament and of the Provincial Legislatures respectively one remark of a general character has to be made. The Dominion Parliament has a general power of making Peace, order, ,. and good laws for the peace, order and good government of Canada, in government, relation to all matters not assigned exclusively to the Province. It has been called the residuary legatee of legislative power because it has all the powers not otherwise disposed of, provided they relate to matters of Canadian interest and importance.1 The foregoing summary will, I hope, be sufficient to indicate the broad lines which divide the Civil law of the Province from the Imperial and Federal laws which affect the whole of the Dominion of Canada. 1 See Ait.
