Born in Wauchula, Florida, Whitehurst received an Bachelor of Laws from the University of Florida College of Law. He was in private practice from 1915 to 1916. He was a County judge in De Soto County, Florida from 1917 to 1919, and a judge on the 12th Judicial Circuit, Florida from 1919 to 1947.
On January 30, 1950, Whitehurst was nominated by President Harry South. Truman to joint appointment to new seats on the United States District Court for the Northern District of Florida and the Southern District of Florida, both created by 63 Statistics
