Die folgende Untersuchung wird zunächst die Arten und Formen der fränkischen Privaturkunde mit Einschluss der fränkischromanischen in's Auge fassen. Anhangsweise soll dann die Urkunde der Alamannen und Baiern, welche sich enge an die fränkische anschliesst, in formeller Beziehung zu kurzer Erörterung gelangen. Das fränkische Urkundenwesen unterscheidet ebenso wie das lombardisch-tuskische zwischen Carta und Notitia. Carta im technischen Sinne ist die dispositive Urkunde, während der Notitia die Rolle der schlichten Beweisurkunde zufällt1). Die Carta wird häufig auch epistola oder testamentum genannt, noch öfter führt sie den Namen des durch sie abgeschlossenen und beurkundeten Rechtsgeschäftes, sie heisst donatio, cessio, traditio, commutatio, concambio, obnoxiatio, obligatio, vindicio, ingenuitas, precaria, commendatitia, affatimum, securitas und so weiter. Die Notitia beurkundet einerseits gerichtliche Urtheile oder processualische Handlungen und heisst dann iudicius2) oder notitia, breve schlechtweg3) oder relatio, relatum4), andererseits bezeugt sie aussergerichtliche ') Ich habe diese Unterscheidung auf Grund fränkischer Formeln in meinem Aufsatze: Carta und Notitia 1877 (Festgaben für Mommsen) des Näheren durchgeführt, kann mich daher hier darauf beschränken, das dort Gesagte kurz zu resumiren, soweit nicht einzelne Punkte einer Ergänzung oder einer schärferen Begründung bedürfen. a) Lex Rib. 59, 7. Heinrich Brunner was born at Wels in Upper Austria on the 22nd of June 1840.
Brunner studied at the universities of Vienna, Gottingen and Berlin.
Brunner became professor at the university of Lemberg in 1866, and in quick succession held similar positions at Prague, Strassburg and Berlin. From 1872 Brunner devoted himself especially to studying the early laws and institutions of the Franks and kindred peoples of western Europe, and on these subjects his researches have been of supreme value. He became a member of the Berlin Academy of Sciences in 1884, and in 1886, after the death of G. Waitz, undertook the supervision of the Leges section of the Monumenta Germaniae historica.
