He was admitted to Advocate in 1787. He held the office of Member of Parliament (Member of Parliament) for Peeblesshire between 1800 and 1831. He succeeded to the title of 2nd Baronet Montgomery of Stanhope, Peeblesshire (creation of 1801 in the Peerage of the United Kingdom) on 2 April 1803. He held the office of Lord Advocate of Scotland between 1804 and 1806.
