It follows that the true division of obligations in a treatise on Municipal Law is not into those wlnch arise from obedience and those which arise from engagement, but into those which arise with the consent of the persons subject to the obligations, which may be either express or implied, and those which arise without their consent by law. It is, of course, not inconsistent with this view, that antecedent to, or independent of, any particular human law God had revealed, or reason, the highest faculty of man, had recognised, certain rights as necessary. The ascertainment of what these necessary rights are is the proper province of the Philosophy of Law. When we pass from Stair's general divisions to his treatment of particular subjects, what is chiefly to be remarked is the different bulk and relative importance of the commercial branches of the law at the time he wrote and in the present day. Thus Bills of Exchange are only treated incidentally under the title of loan or mutuum.1 Trust,2 one of the most important departments of modern law, in the same manner, is considered as a subordinate species of mandate, and it is observable that, like mandate, it was capable of being proved by witnesses until the Act 1696, c. 25, restricted the proof to writ 1 lust. i. Excerpt: ... general plead defences competent to the commonidebtor, for these should be pleaded by the common debtor himself; and the law presumes, if they are not, that the debt in respect of which the arrestment was used must have been due. Thus the arrestee cannot plead that such debt has been paid or compensated (d). But although the arrestee cannot plead that the debt in respect of which the arrestment proceeded was not due, he may plead that it has not been properly constituted, in respect the common debtor was not subject to the jurisdiction; for unless the common debtor has been made a party to the proceedings, the arrestee cannot pay in safety (e). 6. The common debtor may state any defences competent in a direct action against himself for the debt, and also any defences to the regularity of the arrestment. Besides the defenders called, any person having interest in the subject arrested may compear and state defences. Where rents had been arrested for a husband's debts, and a furthcoming brought, the wife appeared and produced a title by which prime facic the firs mariti was excluded, and it was held the furthcoming could not proceed until the creditor had established in a competent process whether this was so or not (f). Where any of the parties to a furthcoming die pending process, their representatives are sisted as in other actions. 7. The procedure does not differ from that in other actions. The final decree is in this or a similar form: " Decerns against the, arrestee, conform to the conclusions of the libel (or to make payment to thg pursuer of the sum of £ owing by him to the sai debtor); and decerns against the said debtor, for his interest and expenses."
