He attended Jamaica High School. He graduated from York College City University of New York and Brooklyn Law School.
In November 1992, after re-apportionment, he ran in the 11th District for re-election, but was defeated by Republican Frank Padavan, the incumbent of the old 11th District. He was a Justice of the New York City Civil Court from 1994 to 1999. And was Supervising Judge of the Queens Civil Court from 1997 to 1999.
In November 1999, he was elected to the New York Supreme Court (11th Doctorate), and was appointed as Administrative Judge of the Civil Term in 2007.
Weinstein was a member of the New York State Senate from 1979 to 1992, sitting in the 183rd, 184th, 185th, 186th, 187th, 188th and 189th New York State Legislatures.
