This 9th edition of Constitutional Law in a Nutshell summarizes constitutional law from Marbury v. Madison (1803) to the present. This edition features some new and controversial cases. A new and famous example is Obergefell v. Hodges (2015) which held, per Justice Kennedy, 5-4, that under both the Due Process and the Equal Protection Clauses of the Fourteenth Amendment “same sex couples may exercise the fundamental right to marry in all States.” In Fisher v. University of Texas (2016) the Court held, 4-3, per Justice Kennedy, that the much litigated, race-conscious admissions program of the University of Texas was valid under the Equal Protection Clause. In the area of “a woman’s right to decide to have an abortion,” the Court in Whole Women’s Health v. Hellerstedt (2016) upheld, 5-2, the use of rigorous undue burden standard as the measure of the abortion right. The Court ruled that two provisions of a Texas law targeting the state’s abortion clinics were unconstitutional under the Fourteenth Amendment. The First Amendment, as always, continues to generate new and important decisions. Thus, Reed v. Gilbert (2015) held that a town sign ordinance violated the First Amendment. The court indicated that any speech regulation directed to a specific subject matter should be evaluated under the strict scrutiny standard. The decision leaves open a question as to whether this ruling is intended to be applied to previously less protected categories of expression. This edition, of course, contains numerous other important decisions. The objective is to summarize the essence of the Court decisions and to do so in a concise and understandable way.

Professor Barron joined the faculty in 1965. He served as dean of the Law School from 1979 to 1988. Professor Barron holds one of the prestigious endowed professorships at The George Washington University - Harold H. Greene Professor of Law.
This professorship was established in 2000.
Professor Barron has also held the endowed professorship of Lyle T. Alverson Professor of Law. Professor Barron teaches and writes in the areas of constitutional law and communications law and on First Amendment issues.
On October 12, 2007, a symposium was held to commemorate the 40th anniversary of Professor Jerome Barron’s seminal article in the Harvard Law Review calling for an affirmative First Amendment right to access the press United States. Supreme Court Justice Stephen G. Breyer was one of the speakers at the event.
Argued and participated in First Amendment cases in the United States. Supreme Court Served as a consultant to the Senate-convened Select Committee on Presidential Campaign Activities (Watergate) Chair of the American Bar Association Committee on Graduate Legal Chair, Mass Communication Law, AALS Chair, Graduate Legal Committee, American Bar Association In 2004, he was the Fulbright Distinguished Chair in Law at the University of Trento in Italy.
Author of dozens of Law Review articles, chapters in books, and book reviews. Barron argued the cause for appellee in Miami Herald Publishing Company v. Tornillo, 418 United States. 241 (1974).
Professor Barron"s son, David Jeremiah Barron, is a professor of law at the Harvard Law School and has been nominated to serve as a judge on the United States Court of Appeals for the First Circuit.
He also was acting head of the Office of Legal Counsel in the Obama Administration. Professor Barron was mentioned in a 1974 Time magazine article.
