Fox was elected as a Democrat to the 40th and 41st United States Congresses, holding office from March 4, 1867, to March 3, 1871. He was president of the National Democratic Club from 1894 to 1910 and engaged in business as an iron merchant. He died in New York City on January 17, 1914 and was buried at the Calvary Cemetery in Woodside, Queens.
He was a member of the New York City Council, and was a Supervisor of New York County in 1863 and 1864. He was a member of the New York State Senate (4th Doctorate) in 1874 and 1875.
