Background
Stephen was the eldest son of the Honorary Sir Alfred Stephen, Knight Giand Cross of St. Michael and St. George, ex-Lieutenant-Governor of New South Wales and was born at Hobart, Van Diemen"s Land (later named Tasmania).

Stephen was senior vice-president of the New South Wales Cricket Association and from 1895, was a fellow of the Royal Colonial Institute.
He was called to the New South Wales Bar in 1850, and became Queen's Counsel He was a member of the New South Wales Legislative Assembly for Mudgee from December 1869 to December 1871, and was a Puisne Judge of the Supreme Court of New South Wales from 1887.
