Expelled from Communist Party for membership of Zinov’yev bloc but re-admitted to Party after publicly recanting his errors and expressing solidarity with Party and government policy. December 1934 tried for complicity in 1 February 1934 assassination of Kirov in Leningrad. 29 December 1934 sentenced to death by Assizes of Military Collegium, Union of the Soviet Socialist Republics Supreme Court.
