In a daring confrontation with his monarch, Chief Justice Coke repudiated government under man in favor of government under law. Non sub homine sed sub Deo et lege. Eventually the Rule of Law--a precept at least as old as the works of Aristotle--became a prime principle in the Anglo-American way of life. Legal rules, however, are not sefl-executing, and judges too are terrigenous creatures. If most of them are more law-abiding then were kings, perhaps that is because the appellate process achieves what it is supposed to achieve. But what of those at the judicial summit whose decisions are not subject to appellate review? As Mr.Justice Jackson put in, "We are not final because we are infallible, but we are infallible because we are final."
