Walter Malins Rose was born in Toronto, Canada, the son of Henry J. Rose. Later the family moved to Ontario, California.
Walter attended Chaffey College. In 1895 he received the degree of B. A. from Stanford University and the following year graduated from the law school of Cornell University, winning also the Boardman thesis prize.
In September 1896 Walter was admitted to the California bar and entered into practice with Robert Hayne in San Francisco. Three years later he was admitted to practice before the United States Supreme Court, but owing to ill health, he was forced to relinquish his practice and moved to Arizona.
Between 1899 and 1901 he published a twelve-volume work, with an additional index volume, entitled Notes on the United States Reports, treating cases reported from 2 Dallas to 172 U. S. The work purported to show "the present value as authority of the cases therein reported as disclosed by all subsequent citations in all the courts of last resort, both Federal and state. " Clearly it was an ambitious undertaking for one so recently called to the bar. His classification of material followed a chronological arrangement, in outline, of points of law determined in Supreme Court decisions, with subsequent citing cases listed. The citations of each annotated case were arranged under the respective points of law involved, and by a further classification, cases affirming a principle were treated separately from those qualifying or denying it. Both the conception and the method were new and afforded a distinct departure in the field of legal authorship.
In 1917 a revised edition of the work was published by Charles L. Thompson. Rose's next undertaking was an application of the new method to the case law of a single state. In a five-volume work, Notes on Texas Reports, published in 1902, he presented a "chronological series of annotations of the decisions of the Supreme Court and the various civil and criminal appellate courts of Texas, showing their present value as authority as disclosed by all the subsequent citations" thereof. A posthumous edition was published in 1910 and there have been later supplements.
In 1903 he published a three-volume Digest of the United States Reports from the Beginning to the October Term, 1902, a task for which his previous labors had especially fitted him. This was followed in 1907 by his Code of Federal Procedure, in three volumes, based upon Robert Desty's manual relating to the same subject but with material rearranged "along more modern and satisfactory lines. " His "Code" provisions were taken from the Constitution, acts of Congress, court rules, and decisions, all topically arranged. He also published monographs on leading cases.
About 1906 he moved to Los Angeles and established himself in active practice. He served as counsel for various corporations and in the relatively brief interval before his death was unusually successful. He died suddenly, at the age of thirty-five, after an operation for appendicitis. His wife was Mary (Holt) Rose, of Holt, Ky. , whom he had married on Oct. 19, 1899. She, with a son, survived him.
