This book is designed for use in courses in law schools and university departments of philosophy. It can serve as a text for basic and ad-vanced courses and seminars. Readings include excerpts of classic works of Aristotle, Aquinas, Locke, Hobbes, Kant, Bentham, and Aus-tin. Provided also are excerpts from standard works of twentieth cen-tury philosophers. The book explores contemporary legal discourse with readings on topics such as sociobiology, Islamic law, the legal process school, legal feminism, and critical legal studies. It reprints leading cases on natural rights/human rights and readings from on-line blogs, op-ed essays, news stories and internet publications.

The Fifth Edition of Cases and Materials on the Law of Torts continues the tradition of using, as much as possible, minimally edited cases so that the book can serve as a vehicle for teaching first-year students the essential techniques of case analysis and legal method. The entire book has been modified to accommodate the many developments in the law of torts since the Fourth Edition was published in 2004. For example, the basic chapters on negligence and causation recognize and discuss the now finally adopted Restatement (Third) of Torts: Liability for Physical & Emotional Harm and the recent case law expanding liability for “loss of a chance.” The duty section has also undergone a major overhaul to reflect the conceptual framework by which courts think about duty and to elucidate the pervasive role of foreseeability in courts' duty decisions. As the dedication ofthis book suggests, the genesis ofthis book arises from my association with Cha'im Perelman. Because I was one of the few Americans to comment on his TraUe de l' argumentation: la nouvelle rhetorique, before it was translated into English, I was invited to a conference celebrating the translation ofthat monumental work into English that was held in August 1970 in Santa Barbara, Califomia at the Center for the Study ofDemocratic Institutions, which was then under the directorship of the late Robert M. Hutchins. From that beginning, Professor Perelman and I developed a strong and warm friendship which was cemented when Professor Perelman and his wife, Fela, came to North Carolina in 1979 as a fellow at the National Humanities Center. I enjoyed the occasions on which I was able to participate in the activities of the Centre National de Recherehes de Logique which had been established, under Professor Perelman's aegis, in Belgium. A trip to Brussels was always something to which I looked forward. Since Professor Perelman's sudden and untimely death in January 1984, shortly after he had been singularly honored by being made a baron by King Baudouin, I have benefited greatly from my participation in the programs of the Perelman Foundation which was established through the generosity and efforts ofBaronne Fela Perelman; a remarkable woman in her own right who has now sadly also passed away.

S.JD, Harvard University, 1966. Doctorate (honorary), University Athens, 2007.
He was awarded his Bachelor of Arts in 1955 and his Juris Doctor 1n 1957, both from Columbia University. While at Columbia he was editor-in-chief of the Columbia Law Review. In 1962 he was granted a Diploma in International Law from Cambridge University.
Later, in 1966 he received South.J.D. from Harvard University
Christie was admitted to the bar in New York in 1957 and in the District of Columbia in 1958.
He spent two years in private practice in Washington District of Columbia and from 1960-1961 he was a Ford Fellow at Harvard Law School. From 1961-1962 he was a Fulbright Scholar at Cambridge University.
In 1966 he left the University of Minnesota and returned to Washington District of Columbia where he served as the Assistant General Counsel for the Near East and South Asia of the Agency for International Development. He has been on the faculty of Duke University School of Law since 1967.
He received an Honorary Doctorate from the University of Athens in 2007.
Christie influenced the Duke University academic governance through the so-called Christie Rule, recommended by a committee he was chairing in 1972. The rule aims to guarantee that the voice of the faculty be heard prior to the Board of Trustees reaching significant decisions.
