In 1905 he graduated from Whitsett Institute. In 1909 he obtained a Bachelor of Laws degree from Wake Forest (North Carolina) College.
Hayes received a recess appointment from President Calvin Coolidge on April 6, 1927, to the United States District Court for the Middle District of North Carolina, to a new seat authorized by 44 Stat. 1339.
On November 22, 1911 he married Willa V. Harless. They had six children: Hadley, Johnson, Hayden, Willa Jean, Coral Virginia, Sarah Rebecca.
