He was the eldest son of John Fortescue of Fallapit House, Devon and his wife Honora, the daughter of Edmund Speccot, and succeeded his father in 1595.

He was elected a Member (Member of Parliament) of the Parliament of England for Old Salisbury in 1593 and appointed High Sheriff of Devon for 1622-1623. He died in 1624 and was buried at East Allington, Devon.
