Then he studied law, was admitted to the bar in 1867, and practiced. In 1895, he was elected Surrogate of Rensselaer County.
Comstock was a member of the New York State Assembly (Rensselaer Company, 2nd Doctorate) in 1880. He was a member of the New York State Senate (16th Doctorate) from 1884 to 1887, sitting in the 107th, 108th, 109th and 110th New York State Legislatures.
