Drain received a Bachelor of Arts degree cum laude with honors in 1979 from Yale University and Juris Doctor in 1984 from Columbia University School of Law where he was a Harlan Fiske Stone Scholar for three years. He was a partner in the bankrutpcy department of the New York firm Paul, Weiss, Rifkind, Wharton & Garrison when he was appointed to be judge in 2002. He is also an adjuct professor of law at Saint John"s University School of Law"s Bankruptcy in Master of Laws Program.
