This popular casebook, through the selection of classic and modern cases, provides an excellent tool for teaching students the common law foundations of the criminal law and modern statutory reform, including the Model Penal Code. Along the way, the casebook considers modern controversies (e.g., "shaming" punishment, rape law, self-defense by battered women, euthanasia, the role of culture in determining culpability), and creatively uses literature (e.g., examining insanity through Edgar Allen Poe's The-Tell Tale Heart) and even "brain teasers" to confront (as the Preface states) "the Big Questions . . . that philosophers, theologians, scientists, and poets, as well as lawyers, have grappled with for centuries." Professor Stephen Garvey (Cornell) joins the casebook beginning with this new edition. The Sixth Edition, as in the past, includes some new cases, as well as updates in the notes that bring current issues of criminal law to the fore. New Power Points have been added to the casebook companion website. For more information and additional teaching materials, visit the companion site.

Barkow are nationally recognized scholars. Their cohesive intellectual framework views the law as an instrument of social control, providing an analytical tool with which students can interpret and understand doctrine. (In addition to offering a comprehensive survey of the maj...)
In addition to offering a comprehensive survey of the major concepts and doctrines in criminal law, a unique feature of this book are the many provocative and teachable case selections used to illustrate major concepts. The facts of virtually every case lend themselves to creative teaching and will stick in the memories of both instructor and students. Meanwhile, lucidly organized notes following the cases deliver both doctrine and interesting tangents with clarity and brevity. The new edition also incorporates the most recent significant cases and scholarship, including recent application of traditional criminal law concepts in more complex ""modern"" contexts such as white collar crime. Special features of the book include: • The authors introduce and employ theoretical perspectives in a clear and accessible way. These materials encourage students to understand and apply various approaches to criminal law issues, including liberalism, feminism, critical race theory, and the rights of victims. • Like its predecessor, this edition has uniquely detailed and inclusive coverage of modern day property crimes, and reflects sophisticated contemporary thinking about homicide and rape • The book's extensive treatment of recent white collar corporate prosecutions allows full consideration of controversies where traditional criminal law concepts are also being applied to civil and corporate disputes. • The cases and commentaries promote a clear and thorough presentation of causation, the crime of attempt, group criminality, and defenses. • The authors draw attention to the intersection of civil and criminal liability, encouraging students to consider the differences between criminal law and other types of legal regulation.

(Evidence: The Objection Method is a stimulating casebook ...)
Evidence: The Objection Method is a stimulating casebook that presents the study of evidence the context of a trial. This new Fourth Edition was necessitated by a major development in the law of evidence. The Evidence Rules Restyling Project changed the text of every single one of the Federal Rules of Evidence. The Restyled Rules are set forth in full in an Introduction to the book - in side-by-side form, old and new - together with committee notes. Particular Restyled Rules are also set forth individually where pertinent to the topic discussed in the book. Co-author Daniel Capra, serves as Reporter to the Judicial Advisory Committee on Evidence Rules and had front-line responsibility for the restyled rules. Another co-author, Stephen Saltzburg, served as a consultant on the Restyling project. Where possible, the drafters' perspective on the Restyling amendments has been emphasized. So for example, the Introduction contains an explanation of the Restyling project prepared by Professor Capra. Of course, the principal cases in the book were decided before the Restyled Rules of Evidence went into effect. Where those cases quote the language of the rule, the authors indicate that the quotation is from the rule before it was restyled. Editorial comments concerning restyling are contained in brackets in the cases. This new Fourth Edition continues the practice of the previous edition by including extensive excerpts from the Federal Rules of Evidence Manual, coauthored by Professors Saltzburg, Capra and Michael Martin. This new edition also plays to the strengths of the first three editions. Most importantly, it provides transcript style problems in which lawyers present evidence and argue evidentiary points, and a trial judge is called on to rule. These problems have been updated and amplified in this edition to provide a real challenge for students seeking to master the rules of evidence as well as the art of objection and argument over evidentiary points in a real trial.

(This stimulating casebook presents the study of evidence ...)
This stimulating casebook presents the study of evidence in the context of the trial. A unique feature of this casebook is the wealth of problems based on transcripts. These simulation exercises allow students to master the rules of evidence as well as the art of objection and argument. Special attention is paid to the amendments to the Federal Rules of Evidence that went into effect on December 1, 2000 and those that went into effect on December 1, 2006. Professor Capra, the Reporter to the Judicial Conference Advisory Committee on Evidence Rules, was the principal author of those amendments and the accompanying Committee Notes. Where possible, the Reporter's perspective on the amendments has been emphasized. The important topics of expert testimony and privileges have been completely revised to take account of their increasing dominance in evidentiary development. The Third Edition has extensive treatment of the Supreme Court's recent jurisprudence on the Confrontation Clause--Crawford and Davis--and the important recent developments in the lower courts in determining the scope of Crawford. Special attention is also given to waiver of attorney-client privilege in the era of electronic discovery, and proposed Rule 502 of the Federal Rules of Evidence, written by Professor Capra. The Third Edition of Evidence: The Objection Method also includes four appendices: • The full text of the Federal Rules of Evidence, as amended; • Advisory Committee Notes for each Rule; and • Two articles authored by Professor Capra, noting inconsistencies in both the Advisory Committee Notes and federal case law with the text of the rules.

(Anatomy of a Trial. Volume V, Trying Cases to Win. Descri...)
Anatomy of a Trial. Volume V, Trying Cases to Win. Description (3900 characters maximum): Originally published: New York: Aspen Publishers, 1999. Reprinted 2013 by The Lawbook Exchange, Ltd. xviii, 584 pp. The trial process is the sum of its parts-opening argument, direct and cross examination, and summation. In Trying Cases to Win, nationally known trial lawyer Herbert J. Stern provides an overall blueprint for conduct in the courtroom as he guides the reader through each of these segments. Rather than a collection of anecdotal war stories from various trials, Stern outlines the nuts and bolts of the right-and wrong-approach, processes and strategies for every component needed for trial success. Each volume is available separately. In this volume, Anatomy of a Trial, Stern and his co-author, Stephen A. Saltzburg, bring the principles of the other volumes in the Trying Cases to Win series into action. They offer a line-by-line review of all of the parts of a trial while looking at the importance of emotion in the decision process and its relationship to the facts presented. This detailed analysis, from the viewpoints of the attorney and the jury, demonstrates good and bad advocacy in every stage of the trial. Contents: 1. Opening Instructions; 2. The Opening Arguments; 3. The First Witness; 4. The Second Witness: Nick Craggs; 5. The Sweeney Deposition; 6. The First of "The Blues" Witnesses: Brian Sullivan; 7. The Alleged Villain: Helen Hardy; 8. Concluding the Plaintiff's Case and Motions; 9. The Defendant's First Witness: Mr. Maresca; 10. The Trustee Witnesses; 11. Ms. Hardy Returns; 12. The Ruling on Defendants' Motion; 13. Ms. Hardy Continues and the Defense Rests; 14. Final Motions, Closing Argument, and Verdict; 15. Epilogue; Index. (This work is written for lawyers and district judges who ...)
This work is written for lawyers and district judges who try cases in Texas courts. It is a trial book, designed to ease the task of dealing with evidence issues under the time constraints and pressures that trials, especially jury trials, place on all participants. The authors emphasize the proper techniques for presenting and objecting to evidence at trial. Common evidence issues are arranged by the order of the Texas Rules of Evidence. Lawyers in both civil and criminal trials should be able to turn quickly to the correct section of this book dealing with any evidence issue that arises during trial. They will find guidance as to who bears the burden of proof on the issue, what the judge s role is, and what type of finding for the record they might request. Judges will find similar guidance and will also find proposed findings that can help them make a solid record, and limiting instructions that can enable them quickly and accurately to instruct a jury in most cases This book focuses on the mechanics of how lawyers and judges must deal with evidence issues as they arise at trial and is a highly practical work that is intended to be on counsel tables and judges benches during trials. Governing Rules The discussion of each evidence issue begins with a section on Governing Rules. This section gathers the rules that interrelate in one place and highlights the portions of the rules that are most likely to be important. Key Points The second section is entitled Key Points. This section identifies important aspects of the governing rules, offers strategic suggestions on how lawyers may best use the governing rules, and suggests points judges may want to emphasize. Sample Objections The third section includes sample objections and guidance on making objections at trial. Rulings on the Record, Offers of Proof, and Limiting Instructions The fourth section suggests language that judges may use in making rulings and instructing juries and also recommends that lawyers consider requesting certain rulings on the record. It also suggests how offers of proof might be made and limiting instructions for all of the issues discussed. Rules of Evidence The Appendices include the full text of the Texas Rules of Evidence and several important provisions from the Texas Code of Criminal Procedure that are cited in the text.
