Howe, Daniel Wait was born on October 24, 1839 in Patriot, Indiana, United States. Son of Daniel Haven and Lucy (Hicks) Howe.

Discharged November 10, 1864, because of wounds received in battle at Kenesaw Mountain, Georgia Began practice of law at Franklin, Indiana, 1867, where held offices of city attorney and state prosecuting attorney. Moved to Indianapolis, 1873. Judge Superior Court, 1876-1890.
