The United States of America constitute a union of States, a more perfect Union, to use the language of the preamble to the Constitution, than that under the Articles of Confederation which the Constitution was devised to supplant. On July 4, 1776, the thirteen British colonies lying between the Gulf of Mexico and Canada, to the east of theM ississippi, abjured allegiance to theB ritish Crown and solemnly published and declared themselves to be Free and Independent States possessing, as theD eclaration of Independence stated, full power to levy War, conclude Peace, contract A lliances, establish Commerce, and to do all other A cts and Things which Independent States may of right do. A vailing themselves of their right to contract alliances, they entered into a firm league of friendship with each other, for their common defence, the security of their liberties, and their mutual and general welfare, binding themselves to assist each other, against all force offered to, or attacks made upon them, or any of them, on account of religion, sovereignty, trade, or any other pretence whatever. The present collection of cases on Quasi-C ontracts is prepared to meet the needs of classroom instruction of not more than three hours a week during half a year. While a case-book as such can make little or no pretence to originality in any way, attention is called to the historical treatment of the subject in the first eighteen pages of the book, whereby the quasicontract of the present day is treated as a natural, if unconscious, development of the quasi-contract of theE oman Law. To make clear this connection, frequent reference is made in the footnotes to theE oman and modern Civil Law of the Continent andS panishA merican States. It is hoped that the law of Quasi-C ontract gains in importance and precision, as it certainly does in antiquity and dignity, by treatment as a part of a larger and well-nigh universal system of law. In the next place, the arrangement is different from that with which the public is familiar. The present collection follows, and necessarily, ilr. A mess classification of the nature and extent of quasi-contract, as did Judge Keener, both in his Cases and Treatise; but the non-contractual aspect of the subject is accentuated from the very beginning. After the introductory matter of Book I., the obligation is considered as existing, independent of any contract, and, indeed, its existence is in itself the negation of contract. A s, for example, the obligation of restitution when defendant acquired the plaintiffs property by a tort, or where the money in question was paid by the plaintiff under duress, legal or equitable, or under compulsion of legal process. Then recovery is considered when a contract exists, but the contract itself is due to mistake of law or fact.
