Approximately half a million people are under guardianship in the United States. Guardianship is intended as a last resort, but this court of last resort is an institutional fiefdom that has historically received little scrutiny. As the national population ages and the lifespan increases, more people are potentially subject to being adjudicated incompetent in court and having a guardian appointed as a surrogate decisionmaker. This book informs health, social service, and legal professionals, as well as judges and legislators about the findings, analyses, conclusions, and implications from over a decade of national and state research on guardianship and protective services for the elderly and disabled, directed by one of the nation's leading experts on guardianship. The book begins with an overview case study of guardianship and the need for reform from the state that represents America's demographic future, Florida. Exploration of the extent of unmet need for guardian services follows. Findings from a national study of public guardianship and the elderly are detailed. The actual functioning of guardianship court is reported by addressing several questions. What happens to people in the court of last resort? What is known and what is not known about guardianship? What happens beyond the court of last resort in the even more hidden area of involuntary adult protective services? The conclusion consists of a model public guardianship statute and commentary that is a product of the research on guardianship. The statute is designed to provide a framework for much-needed reform of the court of last resort.

Winsor Chase Schmidt Jr. was born on March 28, 1949, in Johnson City, New York, United States to Winsor Chase Schmidt and Miriam Isabel Tebbetts Schmidt.
Schmidt graduated from Harvard University in 1970. He then obtained a Juris Doctor degree from American University in 1973, and a Master of Laws degree from the University of Virginia in 1984.
Schmidt started his career as an attorney at Law Offices L.M. Brister in Owego in 1973. However, he decided early on that he preferred teaching to the practice of law. Since 1976, he taught as an associate professor of public administration at Florida State University. In 1983, he went to University of Virginia School of Law and in 1986 he became a professor of political science at the University of Memphis. In 1989 he started working as an associate professor of law at Pace University at White Plains.
For the next 2 decades Schmidt was endowed chair/distinguished professor of Urban Health Policy at the University of Louisville School of Medicine where he held faculty appointments as a professor of psychiatry and behavioral sciences and professor of family and geriatric medicine, and as a professor of Health Management and Systems Sciences in the School of Public Health and Information Sciences.
Since 2015, Schmidt held the position of the Metrolina Medical Foundation Distinguished Professor of Public Policy on Health in the Department of Public Health Sciences at the University of North Carolina at Charlotte.
In addition, Schmidt has served on the board of directors of several organizations concerned with the rights of the individual in medical and legal matters.
For many years, Schmidt has been considered an expert on the subject of the legal rights of the elderly and incapacitated. With Kent Miller, William Bell, and Elaine New, he wrote the authoritative 1981 work Public Guardianship and the Elderly. In 1995, he edited Guardianship: Court of Last Resort for the Elderly and Disabled.

1995Schmidt was a fierce advocate for rigorous graduate education and for the professional success of his students.
Schmidt was a member of the American Bar Association, American Society of Law, Medicine, and Ethics, American Political Science Association and District of Columbia Bar.
Schmidt married Lenore Boudreau on August 23, 1975. The couple has one son, Winsor Chase III.
